Terms of Service

1. Agreement
These Terms of Service govern your access to and use of the Estatz platform. By creating an account or using the service, you agree to these terms. If you do not agree, do not use Estatz.
2. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or relating to these terms or your use of Estatz will be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
3. Accounts
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep it up to date. You may not share your credentials with any other person or create multiple accounts for the same individual.
4. RERA Requirement
Certain features of Estatz, including portal syndication, listing management, and broker networking (DealHub), require a valid RERA registration issued by the Dubai Land Department. By using these features, you represent and warrant that you hold an active RERA card. Estatz may verify your RERA status and restrict or revoke access to gated features if verification fails or your registration expires.
5. Free Trial
New accounts receive a 7-day free trial with full access to all features of the selected plan. No credit card is required to start a trial. At the end of the trial period, your account will be suspended until you subscribe to a paid plan. Your data is preserved during suspension.
6. Subscriptions and Billing
Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. Prices are listed in AED and are inclusive of applicable charges. Plan upgrades (monthly to yearly) take effect immediately with prorated billing. Plan downgrades (yearly to monthly) take effect at the next billing date. Payments are processed securely by Stripe.
7. Refunds
Subscription fees are non-refundable except where required by applicable UAE law. If you cancel during a billing period, you retain access to the service until the end of that paid period.
8. Agency Accounts
Agency plan administrators are responsible for the activity of all team members under their account and for compliance with these terms across their team. Adding a team member creates a billable seat, charged immediately. Removing a seat takes effect at the next billing cycle. A maximum of 50 team members may be added per agency account. The administrator is the sole account owner and is responsible for managing team access, permissions, and compliance.
9. Acceptable Use
You agree not to misuse the service, attempt to disrupt it, reverse engineer it, or use it to violate any law or the rights of others. This includes compliance with all applicable UAE regulations governing real estate brokerage, advertising, data protection, and communications. You agree not to use Estatz to send unsolicited communications in violation of RERA regulations or the UAE PDPL.
10. API and Automation
Use of the Estatz API and automation features is subject to rate limits and fair use policies. Automated requests must not exceed published rate limits. You may not use automated tools to scrape data from, overload, or interfere with the service. API access may be suspended or revoked for abuse without prior notice.
11. Intellectual Property
Estatz and its original content, features, functionality, design, and branding are owned by Estatz and protected by applicable intellectual property laws. You retain full ownership of all data you enter into Estatz - your clients, deals, listings, documents, and communications remain yours. We claim no intellectual property rights over your content.
12. Data and Privacy
Your use of Estatz is governed by our Privacy Policy, which explains how we collect, process, and protect your personal data. By using Estatz, you consent to the data practices described in the Privacy Policy.
13. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted or error-free access to the service. Planned maintenance will be communicated in advance where possible. We are not liable for downtime, data delays, or service interruptions caused by factors beyond our reasonable control, including but not limited to internet connectivity, third-party service outages, and force majeure events.
14. Limitation of Liability
To the maximum extent permitted by the laws of the United Arab Emirates, Estatz total aggregate liability to you for any and all claims arising from or relating to your use of the service is limited to the total fees you have actually paid to Estatz in the 12 months immediately preceding the event giving rise to the claim. In no event will Estatz be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost commissions, lost deals, lost profits, or lost data, regardless of the cause of action or the theory of liability.
15. Data Export on Termination
Upon cancellation, you may export your CRM data (clients, deals, listings, documents) via CSV at any time during the remaining paid period. After your paid period ends, your account is read-only for up to 90 days, during which export remains available; it is then closed. After 180 days from suspension, all data is permanently deleted in accordance with our Privacy Policy. We recommend exporting your data before cancellation.
16. Termination
You may cancel your subscription at any time from your billing settings. Estatz may suspend or terminate your access for material breach of these terms, including but not limited to: violation of RERA regulations, misuse of the platform, non-payment, or activity that threatens the security or integrity of the service. We will provide reasonable notice before termination except in cases of serious or urgent breach. Upon termination, your data is handled in accordance with our data retention and deletion policies as described in the Privacy Policy.
